Lindis was arrested for suspicion of criminal damage and alleged 'aggravated trespass' after the Buckingham Palace protest.  She was not charged with any alleged offence but was released and bailed to return to Charing Cross police station on 10 December at 2 pm.  She was notified on 8 December that 'no further action' is to be taken.

3 April 2003 - Lindis Finally Released from Remand

After a huge struggle at Daventry Magistrates' Court today Lindis was finally released from remand (Holloway) on bail conditions not to go within 5 metres of 10 named RAF bases ... bases occupied and controlled by the American Visiting Forces. (Croughton, Fairford, Welford, Molesworth, Lakenheath, Mildenhall, Feltwell, Alconbury, Menwith Hill and Fylingdales ... I think!)

Initially the Crown prosecutor asked for Lindis to be re-remanded back to Holloway because of the serious nature of the charge (alleged 'aggravated trespass' for climbing into USAF Croughton and peacefully displaying an upside down, distressed, US flag bearing the words: 'WAR ON IRAQ, IMMORAL UNLAWFUL MADNESS' can surely not be that threatening!).

Then stringent bail conditions were requested not to go within 200 metres of any military establishment in the UK, plus a 9pm - 7am home curfew with daily police doorstop checks plus reporting to her local police station 4 times a week! At this point Lindis requested an ajournment to speak with her solicitor.

We are grateful to Tim Green from Birnbergs solicitors who represented Lindis and managed to get the lesser bail conditions.

Three American military personnel were again at the back of the court and at one point the two magistrates asked them for assistance regarding American bases. They replied that all the bases are known as 'RAF'.

Throughout her time on remand Lindis has again paid a high personal price for declining the sexually abusive practice of strip searching and she intends to take this issue further.

There were no reporters in court.

Lindis is now back home. Thank you to everyone who sent messages of support.

BBC TV Question Time was being recorded in Hull on Thursday evening.  Among the panalists was Robin Cook - Leader of the House of Commons and previously Foreign Secretary of the UK government.
 
Lindis Percy was the lone protester waiting to greet him when he came out of Hull Civic Hall.  She held the US flag with the words "THE ROGUE STATE" written on and spoke to him about the pending US/UK attack on Iraq.  He did engage in a brief conversation with her and then got into his chauffeur driven car. 
 
Lindis quietly stood in front of his car - holding the US flag and declined to move.  She stood there for about quarter of an hour.  The police eventually arrived. Lindis was arrested for 'obstruction of the highway' - the police having tried to arrest her for a 'breach of the peace'.  However Lindis reminded them that it would be unwise to do this because of the case of Percy v DPP (Balcolm and Collins 1994) - a change in the law concerning breach of the peace. 
 
The car left and Lindis was immediately 'dearrested' -with none of her details having been asked for by the police.

Alleged Corruption

A Metropolitan Police Anti-Corruption Unit consisting of a Deputy Assistant Commissioner, together with a team of 8 officers (all MET) sealed the office of Detective Chief Superintendent NICHOLS (MDP) at the Headquarters of the Ministry of Defence police Agency at Wethersfield to investigate alleged discrepancies (amount unknown at present) in the Informants Fund.

The MDP Agency issued an official Force Order on 10 July 2002 confirming the suspension of their Head of CID, Chief Superintendent Geoff Nichols with effect from Monday 8 July.
 


CAAB ACTION - 17 July 2002 Update

Lindis was informed yesterday that the Crown Prosecution Service have decided not to proceed with this charge.  This is the second case that has been discontinued recently and has meant that Lindis has been remanded in custody (re USAF Croughton) and spent 13 hours in custody (re below) with no redress apart from claiming costs.


Bankruptcy petition - 24 April 2002

Lindis received a summons on 24 April 2002 for an Order to pay the MOD £50,285 18p for costs awarded against her involving three cases in the High Court sometime ago.  She was given 18 days to pay and if she has not paid within this time the Treasury Solicitor will petition for bankruptcy against her in the High Court London.

Lindis has since received a revised bill of £49,517 68p because a mistake was made in the original Order.

The cases involved hearings for two permenent injunctions on US bases (Lindis has five at Menwith Hill, Lakenheath, Mildenhall, Alconbury and Feltwell) and the Claim for an injunction to stop the building of the two SBIRS radomes at Menwith Hill in 1999.

Alconbury

CAAB was present at USAF Alconbury on 20 August 2001 to protest against the American Missile Defense plans. We again used the US flag with the words STOP STAR WARS on. Anni went someway into the base and held up the flag for about three quarters of an hour. After declining to leave a Ministry of Defence police officer eventually warned Anni under section 69 (Criminal Justice and Public Order Act) that if she returned within three months she would be arrested.

Lindis has a permanent injunction at the base (one of five) and protested at the entrance of USAF Alconbury with the US flag with 'STOP STAR WARS' in large letters.


Chicksands

July 10 2000

Lindis climbed into the base on the first day of the Y2000 Reunion for Americans who have worked there up to 1995 when it was handed back to the British. She 'visited' the officers mess and wrote in the visitors book and then lowered the 'stars and stripes' flying outside on a flagpole and added one with the words 'STOP STAR WARS' underneath and raised both to half-mast. After about 10 minutes a British soldier raised them to the top of the flagpole and was ordered to 'get that thing down' when it was noticed. She retrieved the offending flag and was escorted off the base. The civil police were called but took no action after checking she had no bail conditions or restraining orders against her re Chicksands.

"Two defense officials said in anonymity Tuesday that the Pentagon wants to erect some half dozen mobile shelters on the British island of Diego Garcia to house B-2 bombers now based at Whiteman Air Force Base in Missouri.

Basing the bombers at the Indian Ocean site would cut in half the distance they would fly to reach Iraq for any missions.

One official said he didn't know whether the British has been formally asked for permission or if the idea was just informally discussed with them by the U.S. Central Command, which is in charge of the American military in some two dozen countries from Africa to Asia. But the Air Force for years has been talking about getting more bang from its bombers by having them carry out more wartime missions from air bases outside the continental United States".

CAAB was at the US Deep Space Tracking Center and Near Space Facility at Feltwell in Norfolk on Saturday 8 June 2002 to witness and protest at the probable role of this base in the American Missile Defense system.

Anni entered the base in her wheelchair - passing the US military security personnel on duty at the Main entrance.  She went near to the operations compound where there are five radomes.  She was not stopped by the US authorites and holding the US flag with STOP STAR WARS written on, waited for the Ministry of Defence police to arrive.  They took about half an hour to come from USAF Lakenheath.

Meanwhile Lindis was protesting  with the US flag with STOP STAR WARS written on it by walking to and fro across the Main entrance.  Traffic was not allowed to enter or exit the base and as a result a queue of traffic built up.  The base was 'shut down' for a short time.  No action was taken against Lindis who has a case in the courts soon for an almost identical alleged incident concerning Feltwell.

Anni was warned under s. 69  of the Criminal Justice and Public Order Act 1994 not to enter the base for 6 months (the MDP were incorrect in their warning incidently).  

Work is going on on one of the radomes at Feltwell and at Menwith Hill at the moment.

CAAB witnessed and protested at the US Deep Space Tracking Center and Near Space Facility at Feltwell, Norfolk on Saturday 19 January 2002 . This base may be used in the American Missile Defense System ('STAR WARS').

This was the first time that use of the US flag had been tested at Feltwell since the Judgement in the High Court London. The appeal was upheld by Mr Justice Kennedy and Mrs Justice Hallett who ruled that the conviction for using 'threatening, abusive and insulting words or behaviour likely to cause harassment alarm or distress contrary to section 5 of the Public Order Act 1986' was incompatible with article 10 of the European Convention on Human Rights.

Lindis had walked quietly backwards and forwards across at the Main gate of the base with the US flag with 'STOP STAR WARS' written on it.  She was eventually arrested for 'obstruction of the highway' by the Ministry of Defence Police. She was taken to Thetford Police Station and charged with the alleged offence.  Bail conditions were imposed:

Not to go within 500 yards of any American airbase in East Anglia.

Lindis will be making an application to the court to vary these bail conditions.  She is bailed to the court on 24 January 2002 .

Feltwell Vigil - Report

On Saturday 16 December 2000 Lindis Percy (CAAB) was arrested outside NSA Feltwell by the Ministry of Defence police (MDP) for 'Obstructing the Highway'. She was witnessing and protesting at the probable use of the Near and Deep Space Tracking Facility at NSA Feltwell in the American National Missile Defense (NMD) programme. She was holding a 'Stars and Stripes' flag with the words 'STOP STAR WARS' written on it at the Main Entrance to the base.

Lindis was taken to Thetford Police Station and charged with 'Using threatening, abusive or insulting words or behaviour or disorderly behaviour within the hearing or sight of a person likely to be caused harassment, alarm or distress which was racially aggrevated in accordance with Section 3 (1)(c) of the Crime and Disorder Act 1998 contary to Section 5 of the Public Order Act 1986 as amended by the Criminal Justice and Public Order Act 1994'

Bail conditions were imposed not to go within 500 yards of the American bases at Feltwell, Mildenhall and Lakenheath - Lindis had witnessed at all three bases during the day.

Lindis' witness was quiet and peaceful and CAAB will continue to quietly and peacefully witness and protest against the American NMD system and the lack of accountability of American bases.

Molesworth

Molesworth - digging for the truth.
Fourteen of us went from Leicester and we were met by Virginia and her three lovely children from the Eirene Centre. Two more in total than we had in April. To quote from the far left "We are building".  It was an amazingly hot day.  Something wrong there, it's supposed to be horribly cold and windy at Molesworth, but no this time, warm sunshine.  We were greeted at the Main Gate by a MoD Plod who asked  us whether we would like him to close the  main gate so we could stand in front of it for a bit.  "Well er, yes, OK, suppose so, good idea".  I don't know, last time when we went in April it was cups of tea, now they are organising our demo; what is the world coming to?

We hung our banners up around the gate, and stood with our rainbow peace flags flying in the breeze while Richard did the photos.  Then we hacked our way into the dry stoney earth of the peace garden and planted a buddlia that I had rescued from one of my drain pipes, and a nice selection of winter pansies.  Jill made us cups of tea and I handed round a few tasty nibbles.  We signed a greetings card to Marlene, who had unfortunately broken her knee cap in the cause of peace at Lakenheath. We then did a quick trot up a bit of the bridle path before returning to Leicester.

No armed US in sight, just MoD and US police.  BUT 15 minutes later when Virginia walked back to Eirene around the other side of the base and stopped at the Cockbrook Lane gate a rather different image presented itself.  The other side of the coin. This is after all "the hub of US Intelligence in Europe. ..of great strategic importance to the Pentagon" (Duncan Campbell) She was greeted by 5 or 6 armed soldiers and two MoD cars.  The man at the gate asked her what she was doing and told her to go the the main gate.  She pointed out she was outside the fence and not intending to enter the base.  As he seemed fairly threatening Virginia stood her ground and said "I'm a UK citizen on UK soil, I have no intention of coming into your base, ...I come in peace" at which point his colleagues said "Of course ma'am no worries" and so did he.  So touchy feely stuff at the main gate only.  Or do they feel particularly threaten by a woman with two pretty little girls and a baby in a push chair?  Push chairs for peace next time?

The Campaign for the Accountability of American Bases (CAAB) was present at the American Joint Analysis Center at Molesworth (Cambridgeshire) and again researched the base for 2 and a half hours unnoticed.  Lindis was in the 'secure' blast proof Armoury building when an American military serviceman asked her if he could help her.  She said that she hoped he could as she was also there to protest at the role of Molesworth in the pending US led war on Iraq.  He quickly shut the door and called 'security'.

Meanwhile the gate and door to the Operations Directorate (Warfare Command) building were open.  Lindis went in and while waiting took the opportunity to write a 'suggestion' to the US Base Commander and posted it in the conveniently placed 'suggestion' box on the wall. The Ministry of Defence Police Agency (MDPA) eventually arrived from USAF Alconbury.

Lindis was not arrested but again 'warned' by the MDPA under the Criminal Justice and Public Order Act 1994 (aggravated trespass - s.69) not to return to the base within three months.

'RAF' Molesworth is occupied and controlled by the American Visiting Forces.  In the late 1980s the base was to be home to the second deployment of Cruise missiles.  Instead of closing down after Cruise Missiles were returned to the US Molesworth became the US European Joint Analysis Center (meaning American Forces) for the American military.

The base also became one of five American Regional Joint Intelligence Training Facilities (RJITF) in Europe. The mission of the RJITF is to conduct 'in-theater training', including intelligence organisations, functions and systems. The RJITF is the primary source of joint intelligence training within USEUCOM (United States European Command).

JAC Molesworth also includes an intelligence training school with Mobile Training Teams available to go far afield with intelligence training on the ground and in space. The base offers a range of courses for their European forces with the objective of bringing them into the technological age. It is part of a huge network for America to ensure that their military, economic and world wide interests are assured on earth and in space.  It is a significant and complex base.

USAFE announces 2002 maintenance effectiveness awards -
RAMSTEIN AIR BASE, Germany (USAFENS) – Headquarters U.S. Air Forces in Europe recently announced the 2002 Maintenance Effectiveness Awards in the communications-electronics categories.

The winners are:

Large unit:  86th Communications Squadron, Ramstein Air Base, Germany

Medium unit:  48th CS, Royal Air Force Lakenheath, England

Small unit:  423rd Air Base Squadron, RAF Molesworth, England

The winners will now compete at Air Force level.

Lindis Percy was stopped by Lincoln police on the A15 when she was returning home after researching RAF Digby and the USEUCOM Joint Analysis Center at Molesworth the day before.  There was an airshow at RAF Waddington on Saturday and Sunday which she had to pass on her way home.

She was waiting in a queue of traffic when she was directed on to a side road by the local police and told they had just received instructions to stop her if she happened to come along.

Lindis was searched and so was her car.  The police confiscated several items including tools (always kept in her car because it has been sabotaged so many times when parked outside US bases).  She was not arrested at this stage.  The reason the police eventually gave for stopping her was that she 'might protest'.  When she asked why they had not taken all the tools in the car they did not reply.

Lindis was warned not to go to the airshow on either Saturday or Sunday and that if she did she would be arrested for 'breach of the peace'.  She said several times that she had been on her way home to Hull and had had no intention of going to the airshow.

The police told Lindis that she was to be escorted out of Lincoln by two police motor cyclists.  They then set off.  Just outside Lincoln she had to stop at some traffic lights and one of the police outriders sped off.  He got off his motor bike a little way ahead and directed Lindis into a police station car park where she was told she was under arrest for 'suspicion of criminal damage'.

Lindis was taken to Lincoln police station and held for 13 hours.  The car was later searched again and items removed eg the US flag with STOP STAR WARS written on it, a CAAB reflector jacket, many copies of the latest CAAB newsletter (although she had already given several out to the police) and a copy of the Guardian newspaper.  When she asked the police what the Guardian had to do with 'alleged criminal damage' she was told "it might have articles in it"!   

Lindis was eventually charged with:

"On 29 June 2002 at Waddington had in your custody or under your control articles namely two pairs of wire cutters, a hacksaw, a rope ladder and a can of black spray paint intending without lawful excuse to use the same or to cause of permit another to use the same to destroy or damage property belonging to the Royal Air Force - contrary to section 3 (a) and 4 of the Criminal Damage Act 1971".

Bail conditions were imposed 'not to go within 200 meters of any RAF base' (they had wanted to remand Lindis in custody).

Lindis pointed out to the custody officer that she would be immediately in breach of bail when she was going home as she passed RAF Scampton.  In the end the bail conditons are: 'not to go within one meter of the perimeter fence of any RAF base'.

Apparently Special Branch were involved and it was quite clear (the duty solicitor agreed) that 'higher authority' was behind this.

The search record re the search of the car says:

Object [ of search]:  Prohibited articles, items can [?be] used in terrorism

Grounds [of search]:  Terrorism, known protester against Americans.

Lindis absolutely denies this charge.  The plea date at Lincoln Magistrates' Court is Friday 5 July 2002.

RESISTANCE CONTINUES, GOOD FRIDAY PEACE ACTIVISTS ENTER SHANNON AIRPORT

3am Libation completed at edge of runway in peace

Two members of the radical anti-war Catholic Worker Movement (see www.catholicworker.org ) were arrested inside Shannon Airport in the early hours of Good Friday. Jenny Hannon of Dublin and Martin McGowan of Sligo were detained by airport security and police after making their way into the airfield.

They had constructed a shrine to the Iraqis slain in the recent U.S. military assault, conducted the Catholic Office of the Dead and began to plant a bed of potatoes. By 3.45am they were still airside, where they continued their libation at the edge of the runway in peace.

Jenny Hannon stated, "We come to Shannon Airport on Good Friday to recognise the ongoing crucifixion of the people of Iraq. Our airports have been complicit in the decade-long enforcement of genocidal sanctions, and now the past month of intensified bombing in Iraqi towns and villages.

"By allowing refueling of U.S. military flights at Shannon, Ireland is now co-operating with a huge armed robbery of Iraqi resources to be plundered. The entire infrastructure of Iraqi society - deliberated destroyed by U.S./U.K. bombs in the Gulf Wars - faces privatisation by U.S. corporations - water, roads, hospitals, etc.

"We remember the dead and dying, and plant potatoes as a symbol of new life, returning the land occupied by Shannon Airport to a proper relationship with a God of Life and Love." (see www.refuelingpeace.org )

In early February five other members of the Catholic Worker Movement were arrested after disarming a U.S. Navy warplane at Shannon Airport. Karen Fallon will accept bail later today, joining the other four bailed awaiting trial. (see www.ploughsharesireland.org )
